Case Type

The case types selected should correspond to the most serious charge ever filed in a case, using the charge at indictment, bill of information, or petition.  If a more serious charge is added or amended upward to a more serious type, the Case Type should be changed to reflect this.  The Case Type should not be changed downward unless it was selected in error.  The Dominant Charge (most serious) on the Charges tab should be a charge that reflects the Case Type.  If you are appointed a case before indictment or billing, use the arrest charge as a placeholder and select Pending (Charge is Pending) as the Charge at Indictment/Petition.

Adult Case Types

  1. Capital
    If you receive a case that could be charged as a capital case, and the State has not yet declared whether it seeks the death penalty, or if it has decided to do so, select Capital as the Case Type.  Do not select Capital if it is clear from the outset that it will not be charged as a Capital case and the office has not committed resources to treat it as such.  If the state later decides that it is not seeking the death penalty, continue to use Capital as the Case Type.  When formal notice is received whether or not to seek the death penalty, enter the appropriate Event: Capital: Notice of Death Sought or Capital: Notice of Death Declined.
  2. Felony - LWOP
    This Case Type is to be used only for specific charges where LWOP is a potential sentence.  Use this case type even if the State indicates that it is not seeking Life Without Parole, as long as it a potential sentence for one of the indicted charges.  Use Felony-LWOP also if the potential sentence is effectively a life sentence (99 years) or the defendant faces such a sentence if charged as an Habitual Offender (15:529.1).
  3. Felony
    If there is a Felony charge at the time of billing, select this Case Type, even if all charges are later reduced to Misdemeanors.
  4. Misdemeanor
    The highest charge in the case is any type of misdemeanor.  If a felony charge is added after billing, change the Case Type to Felony.
  5. Parish/Municipal Ordinance
    This highest charge in the case is a local ordinance.
  6. Traffic.
    This highest charge in the case is a traffic offense.
  7. Extradition.
    Select this Case Type only if there are no other charges for which you are representing the defendant.
  8. Revocation
    Revocation should be selected only where the office did not handle the original case.  Otherwise, the case should be reopened and an additional charge of Revocation should be added on the Charges tab.  If the Revocation proceeding is a result of a new case to which the office is appointed, then that case type should be selected for the new case, and a Revocation should be added on the Charges tab.
    For Probation Revocations, enter Probation:  C.Cr.P., art. 900– Revocation Hearing as a new charge.  For Parole Revocations, enter  15:561.7 – Failure to comply with provisions of supervised release
  9. PCR (Post-Conviction Relief)
  10. i. S.O.A.P  (Sex Offender Assessment Panel)
    A defendant convicted of a sex offense is to be evaluated prior to release from incarceration to determine whether the defendant is or is not determined to be a Sexually Violent Predator or Child Sexual Predator and ordered to comply with the provisions of R.S. 15:560.3 et seq

Juvenile Case Types

Select Juvenile as the Case Type.  Then select from the following Case Subtypes

  1. Delinquency-Juv Life
    This Case Type is to be used only for specific charges where Juvenile LWOP is a potential sentence.  Use this case type even if the State indicates that it is not seeking adjudication for a charge with a mandatory disposition.
  2. Delinquency-Fel-grade
    If there is a Felony charge at the time of billing, select this Case Type, even if all charges are later reduced to Misdemeanors.
  3. Delinquency-Misd-Grade
  4. Extradition
    Select this Case Type only if there are no other charges for which you are representing the defendant.
  5. Revocation
    Revocation should be selected only where the office did not handle the original case.  Otherwise, the case should be reopened and an additional charge of Revocation should be added on the Charges tab.  If the Revocation proceeding is a result of a new case to which the office is appointed, then that case type should be selected for the new case, and a Revocation should be added on the Charges tab.
  6. FINS  (Family in Need of Services)
  7. CINC-Child (Child in Need of Care – Representing Child(ren)
    Open one case for each set of children subject to the action.  On the Charges tab, add a “charge” for each child subject to the petition, and enter the child’s name or initials in the Reference field.
  8. CINC-Parent (Child in Need of Care –Representing Parent(s)Open one case for each set of children subject to the action.  On the Charges tab, add a “charge” for each child subject to the petition, and enter the child’s name or initials in the Reference field.
  9. Termination
    If your office provided representation in the CINC case, select Transfer to Termination as the Result Code in the existing CINC case when the state formally seeks to terminate parental rights. Click on the Copy icon at the top of the Case tab, select New Case, check the Copy Case, Copy Defendant, Copy Charges, Copy Related People boxes, and click OK.  Then select Termination as the Case Type [This process could be automated]
  10. Child Support
    If providing services in a case where child support is sought or sought to be modified, select this Case Type.  For each time there is a motion to set or modify the amount of child support, add a new Charge to the Charges Tab and select CS (Child Support) as the Charge at Indictment or Petition.  .
  11. t. Child Support Contempt
    Contempt of an existing Child Support order is alleged. Add a new charge to the Charges Tab and select CSC (Child Support Contempt) as the Charge at Indictment or Petition
